 note = {論文, Articles, 我が国の青少年スポーツの中心である学校運動部活動における体罰の発生は長年継続している重要な問題となっている。本研究では、運動部において指導者から部員に対する体罰行為に関して争われた複数の裁判例について、裁判内での部員と指導者双方の主張に着目し、主張に差異がみられた内容の考察を行うことで運動部における体罰の発生要因について検討することを目的とした。バレーボール部において発生した体罰が争点となった複数の裁判例内の部員と指導者の主張の差異に着目して検討を行った結果、体罰行動前の意識、体罰行動、体罰行動後の意識、の各段階において主張内容に特に差異がみられた。両者の主張にみられた差異における具体的な内容として、体罰行動前の意識段階では「体罰行為に及んだ理由・目的」、体罰行動段階では「実際の体罰行為の程度」、体罰行動後の意識段階では「体罰行為に対する評価」の三点が看取された。さらに、学校教育法における懲戒と体罰の判断基準を示す司法判断にも以前に提示された判断とは異なる基準が判示され、新たな懲戒と体罰の判断基準の揺らぎをみせる様相が看取された。, Occurrence of corporal punishment in school club activities has been an important problem that has continued for many years in Japan. In this study, I focused on the assertions of both members and coaches in the courts regarding a number of court cases where the coaches disputed corporal punishment for members in the sports club. The purpose of this study is to examine the causes of corporal punishment in athletic club by examining the content of differences in assertions.
Examination focused on the differences between members and coaches' assertions in multiple court cases where the corporal punishment in volleyball club. As a result, there were particular differences in the content of assertions at each stage of consciousness before corporal punishment, consciousness after corporal punishment, and consciousness after corporal punishment. Differences between the two assertions were identified as "reason and purpose of corporal punishment," "actual corporal punishment," and "evaluation of corporal punishment." In addition, judicial judgments in the School Education Law, which show the criteria for disciplinary action and corporal punishment,have shown different standards than before.},
